Welcome to Harvest Moon Bakery! We're delighted you stopped by! These Terms and Conditions ("Terms") explain how we run our website, how orders work, our services and what you can expect when you enjoy our baked goods. By placing an order or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this website or place an order. Please take a moment to read them carefully.

These Terms apply to everyone who uses our website, www.harvestmoonbaker.org or purchases our products or services (like baked goods, catering, or gift boxes). We may occasionally update these Terms to reflect new policies or improvements. The version posted here at the time you order will always apply.

1.  About Us

Harvest Moon Bakery is an online bakery offering handcrafted baked goods available for local pickup in San Antonio, TX.

2.  Who Can Order

You must be at least 18 years old to place an order.  By using our website and/or placing an order on our website, you confirm that you are at least 18 years old and capable of forming a binding agreement. 

 

3.  Orders 

  • Pre-orders must be placed on the ordering platform, Hotplate; the link will be provided on the website. 

  • When you place an order, you will receive confirmation via text or email.

  • All orders are subject to acceptance and availability.

  • Special orders may require additional time and coordination.

  • We reserve the right to cancel or refuse an order if ingredients are unavailable, payment issues occur, or we suspect misuse. 

  • Prices are listed in U.S. Dollars and may include applicable fees shown at checkout.

  • Payment is required at the time you order. 

 

4. Pricing and Payment

  • All prices are listed in U.S. Dollars.

  • We accept payment through the ordering platform, Hotplate; you agree to pay all amounts due upon placing your order to include processing fees.

  • We accept major credit/debit cards via secure third-party payment processors.

  • We reserve the right to change prices of products at any time, but changes will not affect orders for which we have already sent an order confirmation.

  • You are responsible for providing accurate order and contact information.

5.  Returns, Cancellations & Refunds. 

  • Because our products are custom, perishable baked goods, there are no refunds and there are no returns.

  • Cancellations must be made at least 48 hours before the scheduled pickup to receive a full refund.

  • No refunds will be issued for cancellations made within the 48 hours of the pickup date.

  • Custom orders (e.g. large event orders and/or catering) may have different cancellation deadlines. These will be communicated at the time of ordering. Deposits for special orders and catering orders are non-refundable.

6. Pickup

  • Pickup is available at the designated location as stated on the ordering platform Hotplate and as stated on the website.

  • Pickup is available during the designated pickup window also stated on the ordering platform Hotplate and on the website.

  • You are responsible for picking up your order during the scheduled pickup window. Any orders not picked up within the pickup window will be forfeited  and discarded. â€‹

7. Allergies and Food Safety

  • While we take precautions, we cannot guarantee a completely allergen-free environment. Our products may contain or come in contact with common allergens including, but not limited to: eggs, milk, wheat, nuts, peanuts, soy, gluten.

  • You are responsible for reviewing any and all allergen information provided and for notifying us of any allergies at the time of ordering.

  • Because our products are perishable, once picked up or delivered, they are your responsibility. Please handle, consume and/or store them properly and within any recommended timeframe; we are not liable for spoilage or related losses after delivery/pickup.

8. Intellectual Property

All content on our website, including images, logos, designs, and product names, are the property of Harvest Moon Bakery and may not be used or reproduced without our written consent. You're welcome to share our treats on social media (and tag us!) as long as it's done in a kind and respectful way.

9. Third-Party Links, Affiliations and Disclaimers

  • This website may contain links to third-party websites or services that are not controlled by us.

  • We're not responsible for their content, products, or privacy practices-so please review their terms if you visit and/or engage with them. 

  • We assume no responsibility for those and make no representations about them.

  • Your use of third-party websites is at your own risk.

10.  Product and Website Disclaimer

We take great pride in our recipes, images, and services. While we strive for accuracy and consistency, small variations can occur-that's part of the charm of handcrafted baking!

Our website is here to inform you of our products and services, but we can't guarantee that every description or image will be error-free or that the website will always be running perfectly. 

​

Except where the law requires otherwise, we do not make promises ("warranties") beyond what we can clearly state. That means:

  • We can't guarantee our products will meet every special purpose or dietary need.

  • We're not responsible for slight difference from images on the website.

  • We can't control factors outside of our bakery (like internet issues).

Nothing here affects your rights under Texas or federal consumer-protection laws.

11.  Limitations of Liability

To the maximum extent permitted by law, Harvest Moon Bakery shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website, products, or services, including but not limited to order delays, allergies, or pickup/delivery issues.

12.  Modification of Terms

We may update these Terms occasionally to reflect new policies or improvements. The date at the top shows when the latest version took effect. By continuing to use our website or place orders after changes are posted, you agree to the new Terms.

13.  Governing Law

These terms follow by the laws of the State of Texas, without regard to conflict-of-law rules. If any disagreement arises, we'll do our best to resolve it quickly and kindly. If that's not possible, any legal matters must be handled in the courts located in Bexar County, Texas.

14.  Shipping Policy

Harvest Moon Bakery does NOT ship.
